1. ACCEPTANCE OF TERMS

By accessing and using the services provided by Yoga With Amber through yogawithamber.com, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

2. ASSUMPTION OF RISK AND LIABILITY WAIVER

2.1 Inherent Risks

While practicing yoga is generally considered safe, you acknowledge that there is an inherent risk of injury associated with any physical activity, including yoga. These risks may vary depending on your physical condition and the nature of the activity.

2.2 Personal Responsibility

You agree to only attempt poses, postures, and techniques that you deem yourself capable of performing safely. Even if you believe a pose or posture is possible for you to perform, you acknowledge that there remains a possibility, however remote, of injury.

2.3 Voluntary Participation

By participating in classes offered by Yoga With Amber, you knowingly, voluntarily, and expressly assume all risk of injury or damage that might arise from your participation.

2.4 Waiver of Liability

You hereby waive any claim you may have against Amber, the instructor, for injury, damages, or loss of any kind arising from or connected with your participation in yoga classes, including claims of negligence. This includes but is not limited to: * Any injury sustained during class * Any costs associated with hospitalization * Physical therapy expenses * Medication costs * Any other expenses resulting from an injury

2.5 Indemnification

You agree to indemnify and hold harmless Amber from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities brought as a result of your participation in yoga classes.

3. CLASS BOOKING AND CANCELLATION POLICY

3.1 Individual Class Bookings ($13)

• Individual classes must be canceled at least 8 hours before the scheduled start time

• Cancellations made with less than 8 hours’ notice will not be eligible for a refund

• No-shows will not receive a refund

3.2 Monthly Membership ($35)

• Membership students may cancel an individual class at any time

• The monthly subscription fee of $35 remains the same regardless of the number of classes attended

• Memberships may be canceled at any time

• Once a monthly billing cycle has processed, no partial or pro-rated refunds will be issued

• Cancellation will take effect at the end of the current billing period

4. HEALTH DISCLOSURE REQUIREMENTS

4.1 Duty to Disclose

You are required to notify Amber of any injuries, medical conditions, pregnancies, or other health concerns that may impact your ability to perform the suggested poses and postures during class.

4.2 Consequences of Non-Disclosure

Failure to disclose known injuries or medical conditions (including suspected or self-diagnosed conditions) will result in full indemnification of Amber in the event a pose or posture causes inflammation, irritation, or any other adverse symptom.

4.3 Modified Instruction

While disclosure of injuries or conditions does not alter the liability waiver outlined in Section 2, it allows Amber to provide alternative postures, restructure the class, or offer a refund if participation is deemed to put you at risk.

5. ONLINE CLASSES AND RECORDINGS

5.1 Personal Use Only

Online classes, recordings, and other digital content are for personal use only and may not be shared, copied, distributed, or reproduced without express written permission from Yoga With Amber.

5.2 Technical Issues

Yoga With Amber is not responsible for technical issues that may affect your ability to participate in online classes, including but not limited to internet connectivity problems, device malfunctions, or software issues.

6. PRIVACY POLICY

Yoga With Amber respects your privacy and will handle your personal information in accordance with our Privacy Policy, which is incorporated by reference into these Terms and Conditions.

7. CHANGES TO TERMS AND CONDITIONS

Yoga With Amber reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to yogawithamber.com. Your continued use of our services after any changes indicates your acceptance of the modified terms.

8. GOVERNING LAW

These Terms and Conditions shall be governed by and construed in accordance with the laws of the state/province where Yoga With Amber operates, without regard to its conflict of law provisions.

9. SEVERABILITY

If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms and Conditions shall otherwise remain in full force and effect and enforceable.
